Personal data subjet to processing

 

The scope of personal data processed by us largely depends on what data you provide us with. Usually it is a first and last name, sometimes a position in a given company, e-mail address, telephone number. For this reason, it is always worth analyzing whether all personal data provided to us (eg in response to an e-mail) is necessary to contact us, whether the part is unnecessary.

 

If you want to subscribe to the newsletter, you must give me your e-mail address and name via the subscription form to the newsletter.

 

In addition to this, we process data about online behavior and preferences  through cookie files (see below). To do this, we use the IP address of the mobile device or computer and the website you are visiting, the URL of the request, the domain name, the device ID, as well as other similar information.

 

We also use information about you to choose the most suitable offer of our products or services. It happens that we ask for your opinion about our products to improve our offer.

We understand processing as anything we can do with such data, e.g. collecting, recording, storing, transmitting, viewing, analyzing, etc.

  • conclusion and implementation of the contract
  • fulfillment of obligations resulting from legal provisions, e.g. tax law, provisions regulating accounting principles,

  • marketing, including profiling. We need your data to personalize the offer sent by e-mail or traditional mail, present it on our website and in our mobile applications. We do this on the basis of consent, but you can always opt out of such marketing, including profiling related to such activities

Legal basis for data processing

 

The legal basis for the processing of personal data will vary depending on the purpose of processing:

 

Personal data processed in order to conclude and execute the contract are processed on the basis of art. 6 par. 1 letter b RODO (it is necessary to perform the contract to which the data subject is a party).

 

After the conclusion of the contract, they are also processed on the basis of art. 6 par. 1 lit. c GDP (eg data from invoices) and for archival and statistical purposes (Article 6 (1) (f) of the Rural Development Law). In the latter case, these are pseudomonised data.

 

The personal data provided to us to contact you are processed on the basis of art. 6 par. 1 lit. of RODO, or your consent resulting from the initiation of contact. The legal basis for the processing after the end of contact is the justified purpose of archiving correspondence for the purpose of showing its course in the future (Article 6 (1) letter f of the RODO).

 

Personal data provided to us during the subscription to the newsletter processed on the basis of art. 6 par. 1 lit. and RODO – consent is expressed when subscribing to the newsletter.

 

Personal data processed in order to match the content of websites, websites, applications and other functionalities to your interests, as well as detection of fraud and statistical measurements, including for the purpose of participating in research of the Internet will be processed on the basis of art. 6 par. 1 lit. f) RODO (legitimate interest of the administrator) or your consent for processing.

 

How long will your personal data be stored?

 

The period of personal data processing depends on the purpose which they are processed for.

 

If you have made your personal data available for correspondence (eg exchange of e-mails), they are archived for a period of 6 years.

 

If you have provided your personal data to us for the purpose of entering into a contract, they are processed for the duration of the contract, including obligations under the warranty, warranty and service (if applicable) and for the period after its completion resulting from tax and accounting regulations and the rules of limitation of civil claims .

 

If you have provided us with personal data in the course of subscribing to the newsletter, they will be processed for the duration of the newsletter, unless you expressly object or request removal.

Providing personal data in order to conclude a contract of execution is necessary for its conclusion.

 

Providing personal data for marketing purposes, including profiling, as well as for analytical purposes is voluntary.

 

What are your rights related to processing of personal data?

 

  • the right to access your data, including obtaining one copy of data,
  • the right to demand the correction of data and their supplementation,
  • the right to delete data – the right to be forgotten (in certain situations),
  • the right to file a complaint with the supervisory body dealing with the protection of personal data,
  • the right to limit the processing of data (e.g., suspending operations on data for some time), with the exclusion of cases specified in art. 18 para. 2 of RODO, among others this right will not apply to the extent to which the processing of personal data will be necessary to pursue possible claims.

 

If your personal data is processed on the basis of your consent, you can also use the following rights:

 

  • the right to withdraw consent in the scope in which they are processed on this basis. Withdrawal of consent does not affect the lawfulness of the processing that was made on the basis of consent before its withdrawal.
  • the right to transfer personal data, i.e. to receive your personal data from a controller, in a structured, commonly used machine-readable format, or the right to request that personal data is sent by an administrator directly to another administrator
  • the right to oppose automated decision making in individual cases (including profiling) of art. 22 RODO
  • you can also object to receiving personalized sales messages from us

 

However, if you have a contract with us, you are not entitled to:

 

  • the right to transfer personal data (due to the lack of conditions set out in Article 20 of RODO),
  • the right to object to the processing of personal data (as the legal basis for the processing of your personal data is Article 6 (1) (b) and (c)),
  • the right to delete personal data is limited only to those data which are not necessary to achieve the objectives indicated in art. 17 sec. 3 point b, d and e of the GDPR, i.e. to comply with the legal obligation to process data, to establish, investigate and defend claims and for archival purposes.

 

You are then entitled to the following rights in connection with the processing of your personal data:

 

  • the right to access your personal data (Article 15 of the RODO),
  • the right to rectify them (Article 16 of the ECR),
  • additions (Article 16 of the ECR),
  • the right to limit their processing (with some exceptions)

All entities entrusted with the processing of personal data guarantee the use of appropriate security measures and the security of personal data required by law.
